Terms of Service

1. Acceptance of Terms

By accessing or using Club Paddle Tap (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and Plymouth Pickleball LLC d/b/a Club Paddle Tap.

2. Who We Are

Club Paddle Tap is operated by Plymouth Pickleball LLC, a limited liability company organized under the laws of the State of Michigan, doing business as Club Paddle Tap. References to “CPT,” “we,” “us,” or “our” in these Terms refer to Plymouth Pickleball LLC d/b/a Club Paddle Tap.

3. User Types

The Platform serves two types of users:

  • Club Administrators: individuals who create and manage organizations on the Platform, pay platform fees, and manage player data on behalf of their club. Club Administrators must be at least 18 years of age.
  • Players: athletes who register for leagues and tournaments. Player accounts may be created by Club Administrators on a player's behalf.

4. Account Registration

To access certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain only one account per person.
  • Keep your login credentials confidential.
  • Be responsible for all activity that occurs under your account.
  • Notify us immediately at legal@clubpaddletap.com if you suspect unauthorized use of your account.

5. COPPA and Minors

The Platform is not directed at children under the age of 13, and we do not knowingly collect personal data directly from children under 13. Club Administrators who register minor players are solely responsible for obtaining verifiable parental or guardian consent before submitting that player's personal information to the Platform. Parents or guardians who believe their child's data has been submitted without their consent may contact us at legal@clubpaddletap.com to request review or deletion of that data.

You must be at least 18 years of age to create a Club Administrator account or to enter into these Terms on your own behalf.

6. Payments — Club Subscriptions

Club subscription fees are billed on a monthly or annual basis via Stripe, our payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current subscription rate. Cancellation takes effect at the end of your current billing period. Refunds are governed by our Refund Policy.

7. Payments — Tournament Activation Fees

Organizations operating on a pay-as-you-go billing model are charged a one-time activation fee per tournament to unlock paid player registration. The fee is calculated based on the number of events in the tournament and displayed before you confirm the charge. Refunds for activation fees are governed by our Refund Policy.

8. Stripe Connect — Club Payment Accounts

Clubs that collect player registration fees through the Platform do so as Stripe Connected Accounts operating on the CPT platform. By enabling paid registration for your organization, you agree to Stripe's Connected Account Agreement and Stripe's Terms of Service.

  • CPT is the platform operator; the club is the merchant of record for player-to-club registration fee transactions.
  • CPT is not a party to transactions between players and clubs, and is not liable for disputes arising from those transactions.
  • Optional tips collected at player checkout are split 50/50, as disclosed to players at the time of checkout: half is retained by CPT as a platform fee, and half is returned to the club or event organizer as non-cash platform credit that may be applied toward their CPT subscription or future tournament activation fees. Organizer tip credit is non-transferable, non-refundable, and not exchangeable for cash.

9. Acceptable Use

You agree not to use the Platform to:

  • Submit fraudulent player registrations or payment information.
  • Scrape, crawl, or send automated requests to the Platform without our written consent.
  • Impersonate another person, organization, or entity.
  • Engage in any activity that violates applicable local, state, or federal law.
  • Attempt to circumvent or disable any security or access control mechanism.
  • Interfere with or disrupt the integrity or performance of the Platform.

10. Intellectual Property

CPT owns all right, title, and interest in the Platform, including its software, design, and CPT-produced content. Clubs retain ownership of their data, including player records, schedules, and scores. By using the Platform, you grant CPT a limited, non-exclusive, royalty-free license to display your club's content (including name, logo, and results) solely as necessary to operate the Platform and provide the services described in these Terms.

11. Termination

CPT may suspend or terminate your account for material violations of these Terms, with reasonable notice where practicable. CPT may terminate immediately in cases of fraud, illegal activity, or conduct that endangers the Platform or other users. Club Administrators may cancel their account at any time via the billing dashboard. Upon termination, your right to use the Platform ceases immediately. Data retention following termination is governed by our Privacy Policy.

12. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

  • CPT is not liable for physical injury, property damage, or disputes arising from pickleball activities organized through the Platform.
  • CPT's total cumulative liability to you for any claim arising out of or related to these Terms or your use of the Platform shall not exceed the total fees paid by you to CPT in the twelve (12) months immediately preceding the event giving rise to the claim.
  • CPT is not liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless Plymouth Pickleball LLC, its members, managers, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of or access to the Platform; (b) your violation of these Terms; or (c) your violation of any third-party right, including any intellectual property right or privacy right.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Wayne County, Michigan. You consent to personal jurisdiction in those courts.

15. Changes to These Terms

CPT may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or in-app notification before the new Terms become effective. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.
